Terms of Service
Effective July 21, 2026
This English text is provided for convenience. The French version is the official one and prevails in case of any discrepancy.
Read section 7 before you train. Clark Coach does not provide medical advice. Physical training carries a risk of injury.
These terms form a contract between you and Groupe Justin ("we", "us") and govern your use of the Clark Coach app and its related sites (the "service"). By creating an account or using the service, you accept these terms. If you do not accept them, do not use the service.
1. Eligibility and age
You must be 14 or older to create an account. If you are a minor, you represent that you have the permission of the person having parental authority and that you can train without particular risk.
2. Your account
- You sign in with an email and password, or with Apple or Google.
- You are responsible for keeping your credentials confidential and for activity carried out through your account. Tell us promptly of any unauthorised use.
- The information you provide must be accurate. Inaccurate body measurements produce unsuitable recommendations.
- Coach-created account. A coach can create an account in your name (section 5). You take control of it by signing in. You may delete it at any time.
3. Acceptable use
You agree not to:
- use the service for any unlawful purpose, or to harm others;
- attempt to access another person's data, or to circumvent our access controls;
- scrape the service's content, decompile it or reverse-engineer it, except as the law permits;
- disrupt the service or subject it to unreasonable load;
- resell or commercially exploit the service without our written agreement.
4. Your content
Your sessions, notes, measurements, programs and conversations belong to you. You grant us the limited, non-exclusive, revocable licence necessary to host, reproduce and display that content solely in order to provide you with the service — which includes making it available to your linked coach (section 5) and processing it through the assistant (section 6). That licence ends when you delete the content or your account, subject to backups.
We do not use your content for advertising and we do not sell it.
5. The coach role
Clark Coach lets a coach support an athlete. When you are linked to a coach, that coach can view and modify:
- your profile, your body measurements and your morphological traits;
- your programs, your enrolments and your session scheduling;
- your sessions, exercises and sets, including during a workout;
- your personal notes and your preferences.
Your conversations with the assistant remain private and are never accessible to a coach.
A coach can create an account in your name from your name and email address. It is their responsibility to obtain your prior agreement, and they represent that they have. We are not responsible for a coach's advice, programs or conduct: the coaching relationship is between you and them, not us. To end a link, or to report an account created without your agreement, write to justin.halaby@groupejustin.com.
6. AI assistant
The assistant is powered by a language model operated by Anthropic. The text of your conversations and some of your training data are sent to it to produce a reply (see the privacy policy, section 6).
Its replies are generated automatically and may be inaccurate, incomplete or unsuited to your situation. They are general training suggestions. You remain the sole judge of what you perform. The assistant makes no diagnosis and replaces neither a health professional, nor a kinesiologist, nor a qualified coach.
7. Health and safety — important notice
Clark Coach is not a medical device and does not provide medical advice. The content of the service — including form cues, programs, morphology-based adaptations and the assistant's replies — is provided as general training information.
Consult a physician before starting a training program, particularly if you have a medical condition or an injury, if you are pregnant, or if you are returning to physical activity after a break.
Resistance training carries an inherent risk of injury. You train at your own risk. Stop immediately any exercise that causes pain, dizziness, abnormal shortness of breath or chest discomfort, and consult a health professional. In an emergency, call 911.
Nothing in this section limits our liability for bodily injury caused by our own fault (section 12).
8. Intellectual property
The service, its code, its presentation and its trademarks belong to us or are licensed to us. Exercise demonstration images and animations are licensed from ExerciseDB (RapidAPI); they do not belong to us and you may not extract, store or redistribute them.
9. Third-party services
The service relies on Supabase, Anthropic, Sentry, ExerciseDB (RapidAPI), Apple, Google, Expo and Vercel. Their respective terms may apply to your use. If you installed the app from the App Store, Apple's Licensed Application End User Licence Agreement minimum terms also apply; Apple is not a party to these terms and assumes no obligation under them.
10. Availability and updates
We do not guarantee uninterrupted availability. The service may be modified, suspended or discontinued. The app updates itself automatically over the air (OTA): the version you run may change without action on your part. Some features remain usable offline; data entered offline is synchronised when the connection returns.
11. Suspension and termination
You may stop using the service at any time and delete your account (see how). We may suspend or terminate your access if you breach these terms or if the law requires it.
12. Warranties, liability and consumer rights
The service is provided "as is". To the extent permitted by law, we disclaim implied warranties and limit our liability to direct damages.
Québec consumers. You have rights that Québec's Consumer Protection Act makes mandatory. Nothing in these terms operates to set them aside. In particular:
- we cannot exclude or limit our liability for our own fault or for bodily injury (s. 10 CPA);
- the legal warranties of quality and durability continue to apply;
- no clause requires you to arbitrate, deprives you of a class action, or prevents you from bringing proceedings before the courts of Québec (s. 11.1 CPA);
- any amendment to these terms is communicated to you in advance and you may refuse an amendment that is unfavourable to you (s. 11.2 CPA).
The exclusions and limitations above apply only to the extent the law permits them.
13. Changes to these terms
We may amend these terms. We will notify you in the app or by email before a material amendment takes effect. Your use of the service after that date constitutes acceptance, subject to your rights as a consumer (section 12).
14. Governing law and language
These terms are governed by the law applicable in Québec. Any dispute is submitted to the courts of the judicial district of Montréal, Province of Québec, subject to the mandatory provisions protecting consumers.
The parties have required that this contract and the documents related to it be drawn up in French. The French version prevails over any translation.
